Amici Curiae Brief of attorneys general of 15 states

On Petition For A Writ Of Certiorari

I.     INTEREST OF THE AMICI CURIAE

II. REASONS FOR GRANTING THE WRIT

A. Certiorari Should be Granted To Establish That a Decision by the People of a State to Prohibit Assisted Suicide Does Not Violate the Equal Protection Clause of the Fourteenth Amendment

1. The Withdrawal of Life-Sustaining Treatment Is Not the Equivalent of Suicide or Assisted Suicide, and Thus, New York's Prohibition of Assisted Suicide Does Not Create Any Class of Similarly Situated Persons

2. New York's Prohibition of Assisted Suicide Is Rationally Related to Numerous Important Governmental Objectives

B. Certiorari Should be Granted To Reaffirm the Essential Role of the States in our Federal System and the Power of the People to Directly Govern Their Own Affairs

III. CONCLUSION
